Protection of Your Personal Information

At CLÉMENT, protecting your privacy is a priority. Aware of the importance of personal information in the digital age, we are committed to ensuring the confidentiality of the information we collect. This privacy policy applies to all personal information collected through our website clement.ca, in store, and during any interaction with our customers (hereinafter the "Services").

Please read this policy carefully. In the event of any conflict between our terms of use and this privacy policy, this policy shall prevail with respect to the collection, processing, and disclosure of your personal information.

When we use the term "personal information," we refer to any information relating to an identified or identifiable individual, directly or indirectly when combined with other information. Personal information does not include information that has been anonymized in such a way that an individual can no longer be identified.

Personal Information We Collect

Depending on how you interact with us, we may collect the following categories of personal information:

  • Contact details: first and last name, billing address, shipping address, email address, and phone number.
  • Financial information: payment and payment card information, transaction details and confirmation. (Full card numbers are processed by our payment service provider and are not retained by CLÉMENT.)
  • Account information: username, password, security questions, preferences, and settings.
  • Transaction information: items viewed, added to cart, added to a wish list, purchased, returned, exchanged, or cancelled, as well as purchase history.
  • Chouchous loyalty program data: member ID, rewards balance, and associated preferences.
  • Your communications with us: information shared during exchanges with customer service (email, phone, chat).
  • Application information: information provided as part of a job application (CV, cover letter, contact details).
  • Technical and usage data: IP address, approximate geolocation of IP address, operating system, device type, browser, pages visited, queries, connection date and time, and other unique identifiers.
  • Video surveillance data: images captured in public areas of our stores (see the "In-Store Video Surveillance" section).

How We Collect Your Information

We collect personal information:

  • Directly from you, when you create an account, make a purchase or return, sign up for our newsletter or the Chouchous program, contact us, or otherwise provide us with your information;
  • Automatically, when you access our Services, through log files, cookies, and similar technologies (see the following section);
  • From third parties, including our service providers and marketing partners.

Log Files and Cookies

When you interact with our website, we automatically collect certain technical data through log files, cookies, pixels, and similar technologies, including: IP address, approximate geolocation, operating system, device type, pages visited and queries, as well as the date and time of connection.

These technologies are used to:

  • improve the service and offer you a personalized experience;
  • remember your preferences and build a consumer profile to suggest relevant content and recommendations;
  • track orders;
  • produce statistics and measure audience;
  • ensure security and prevent fraud.

Audience measurement and advertising cookies. We work with third-party partners for audience measurement and targeted advertising. These partners may place cookies and receive certain browsing-related information in order to present you with ads on other sites and platforms. Our main partners for this purpose are Meta (Facebook and Instagram), TikTok, and Google. These partners process this information in accordance with their own privacy policies.

Your choices. Cookies that are not strictly necessary for the operation of the site (such as advertising and audience measurement cookies) are placed based on your preferences. You may at any time view and modify your preferences through our cookie preference centre, configure your browser to be notified when a cookie is placed, or refuse them. Refusing certain cookies may limit some site features.

Interest-based advertising. You may also opt out of targeted advertising and ad tracking using the following tools:

These opt-out options rely on cookies and apply to the browser and device used at the time of opt-out. If you change devices or browsers, or if you delete your cookies, you will need to renew your choice.

Why We Use Your Personal Information

Depending on how you interact with us, we use your personal information for the following purposes:

  • Providing and improving the Services: processing your payments, orders, returns, and exchanges, managing your account and Chouchous program membership, arranging shipments, remembering your preferences, and personalizing your shopping experience.
  • Marketing and advertising: sending you promotional communications by email, SMS, or mail (with your consent, where required) and presenting you with online advertising tailored to your interests.
  • Security and fraud prevention: authenticating your account, securing payment, and detecting or preventing fraudulent or malicious activity.
  • Communicating with you: responding to your inquiries and providing customer service.
  • Recruitment: processing job applications.
  • Legal reasons: complying with our legal obligations and asserting or defending our rights.

Your Consent

We collect, use, and disclose your personal information with your consent, unless the law authorizes or requires us to do otherwise. Your consent is requested for specific, clearly and plainly stated purposes. Where sensitive information is involved, we obtain your express consent.

You may withdraw your consent at any time, subject to legal or contractual restrictions, by contacting us at the coordinates indicated at the end of this policy. Withdrawal of consent may limit our ability to provide certain Services to you.

For example, in store, your payment card information is required to make a card purchase; however, you may choose to pay in cash without joining the Chouchous program or providing personal information, unless home delivery is required.

Disclosure of Your Personal Information to Third Parties

In certain circumstances, we may disclose your personal information to third parties for legitimate reasons, including:

  • To Shopify and our service providers acting on our behalf (hosting, payment processing, data analysis, customer service, cloud storage, order processing and shipping).
  • To our marketing partners, to present you with advertising and content tailored to your interests (see the cookies section).
  • When you instruct or consent to it, for example to ship an order.
  • To our affiliated companies, within our group.
  • In the context of a commercial transaction (merger, acquisition, insolvency) or to comply with a legal obligation, respond to valid legal proceedings, or protect our rights and those of our users.

Relationship with Shopify. Our Services are hosted by Shopify, which collects and processes certain personal information in order to provide and improve the Services. For more information, please consult Shopify's consumer privacy policy: https://privacy.shopify.com/en.

Disclosure of Information Outside Quebec

Some of our service providers, including Shopify, may store or process your personal information outside Quebec, including outside Canada. Before disclosing personal information outside Quebec, we conduct an assessment to ensure that it receives adequate protection in accordance with recognized personal information protection principles, and we govern such disclosure through appropriate contractual commitments.

Security of Your Information

We implement reasonable security measures to protect your personal information, including:

  • Encrypted communications (TLS/SSL protocol)
  • Access management limited to authorized persons
  • Network monitoring and firewalls
  • Authentication by username and password
  • Regular data backups

No security measure is infallible, however, and we cannot guarantee absolute security, particularly during the transmission of data over the Internet. We recommend that you do not send us sensitive information through unsecured channels.

In-Store Video Surveillance

Our stores are equipped with video surveillance systems in public areas for security and theft prevention purposes. No cameras are installed in fitting rooms, restrooms, or nursing rooms. Images captured are retained only for the duration necessary for these purposes, then destroyed, unless they must be retained longer to follow up on an incident or to comply with a legal obligation.

Retention and Destruction of Your Information

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by law (for example, to manage your account, comply with our legal obligations, or resolve a dispute). When the purposes have been accomplished, we destroy your personal information or anonymize it, in accordance with the law.

Decisions Based on Automated Processing

In certain limited cases, we may make a decision concerning you based solely on automated processing of your personal information, without human intervention. This is notably the case when, for fraud prevention and transaction security purposes, an order is automatically flagged, held, refused, or cancelled based on an automated risk assessment by Shopify or by our fraud prevention tools.

When such a decision is made, you have the right, upon request, to be informed of:

  • the personal information used to make the decision;
  • the main reasons, factors, and parameters that led to the decision;
  • your right to have the personal information used to make the decision corrected.

Your Rights

Subject to the conditions and exceptions provided by law, you have the following rights regarding your personal information:

  • Right of access: obtain access to the personal information we hold about you.
  • Right of rectification: have inaccurate, incomplete, or ambiguous information corrected.
  • Right to erasure: request the deletion of your information, in the cases provided by law.
  • Right to data portability: receive a copy of the computerized information you have provided to us in a structured and commonly used technological format, or request its transfer to a third party.
  • Right to withdraw your consent: see the "Your Consent" section.
  • Right to object: object to the use of your information for certain purposes, including marketing. You may unsubscribe from our promotional communications using the unsubscribe link included in our emails.
  • Right to de-indexation ("right to be forgotten"): request, in the cases provided by law, that the dissemination of information be stopped or that a hyperlink providing access to it be de-indexed.

Complaints. If you are not satisfied with how we handle your personal information, you may file a complaint with the relevant authority: the Commission d'accès à l'information du Québec (CAI) for Quebec residents, or the Office of the Privacy Commissioner of Canada (OPC) depending on your place of residence.

Information About Children

Our Services are intended for parents, guardians, and adults, and not for children. We do not knowingly collect personal information directly from minors. When information about a child is provided to us (for example, a child's first name or size in the context of a gift registry or wish list), it is provided by a parent or guardian. In accordance with the law applicable in Quebec, consent to the collection of personal information about a minor under 14 years of age is given by the person with parental authority. If you believe that a child has transmitted their personal information to us, please contact us so we can delete it.

Third-Party Websites

Our Services may contain links to websites operated by third parties that we do not control. We encourage you to consult the privacy policy of each website you visit. We disclaim all responsibility for the content, practices, or privacy policies of third-party websites.

Changes to This Policy

We may update this privacy policy at any time, including to reflect changes to our practices or for operational, legal, or regulatory reasons. We will post the revised version on this page and update the "Last updated" date.
